What Is The DMCA?

DMCA stands for “Digital Millennium Copyright Act.” It is only applicable for U.S. businesses. For non-US business this is generally called “Copyright Infringement”. It criminalizes the production and dissemination of technology, devices, or services planned to circumvent measures that control access to copyrighted works. It is also known as digital rights management.

DMCA creates a standardized process for copyright holders to ask us/any other businesses to take down infringing content. If any copyrighter owner found any material in any site upon their copyrights, they can submit a claimed notification under the digital millennium Copywrite act.

In your DMCA Terms and Conditions Agreement, the customer have to agree that when they register an account with you – inform your users that any content they post, create or make available through your website must be their own, i.e. they must own the rights to that content.

How You Can File A Notice?

If someone posted content on your website or app that they do not own the rights to. Then you’re required by the DMCA to respond to takedown notices and remove that type of content. If you find that someone other is using your copyrighted content on https://www.Wiserly.io website in an unauthorized manner, then you can submit a DMCA takedown notice by sending an email to our designated copyright agent, but you have to mention the below details with this mail: 

  • Clear identification of the content that you claim is infringing on the copyrighted work.
  • A statement in which you must claim that copyright content infringement is not authorized and the information that you provide is accurate on behalf of copyright owners. 
  • Your contact information with clearly mentioned name, contact number, Email address, so that we can reply to your notice.
  • An electronic and physical signature of the person authorized to act on behalf of the copyright owner.

All legal issues are subject to the jurisdiction of the State of California, USA, only. 

Once you filed your notice, we will review and address all notices that substantially comply with the requirements identified above and respond you very soon and take the required action by removing and changing the infringing material. We will have no obligation to provide a refund in case of such termination. If your notice fails to fulfill all these desires considerably, we may not be able to respond to your notice. 

If you make a false claim, you may be liable for criminal prosecution for civil penalties including money damages. Under Section 512(f) of the Copyright Act, any person who knowingly materially falsifies that material was removed or disabled by mistake or misleading may be subject to the obligation. With DMCA, you can do many things to protect your content. Content owners can handle unauthorized usage of their content by allowing them to file a DMCA takedown notice.
